  • An act of unlawful seizure

    Question ID: 100495

A State shall provide assistance to an aircraft subjected to an act of unlawful seizure. This assistance includes:

CORRET: Provision of navigation aids, air traffic services and permission to land

INCORRECT: Provision of navigation aids, air traffic services, permission to land and refuelling

    Question ID: 100496

A State shall provide assistance to an aircraft subjected to an act of unlawful seizure. This assistance includes:

CORRECT: Provision of navigation aids, air traffic services, permission to land and refuelling if deemed necessary

INCORRECT: Provision of navigation aids, air traffic services, permission to land

    Which is the correct one?

Sadly they are both correct. The policy is to try to keep the aircraft on the ground once it has landed. However, there might be overriding circumstances, for example, the saving of human life, in which it is prudent to give fuel and allow the aircraft to take off.

With these questions sometimes we have to choose the most correct answer.

Just reviving this as I have come across these two questions in the question bank...

Any update on these questions? They do seem painfully contradiactory. Does one simply accept that the words 'if deemed necessary' are enough to qualify refuelling as the correct answer in 100496 but not in 100495?

In short, yes. The idea is to try to keep the aircraft on the ground so refuelling is not a 'standard offering'. However, if it appears that re-fuelling is the only way to preserve life then fuel can be given but it is not offered.

It's an annoying question but it is a valid one.
